On 6 March 2012, the Joint Committee for EU Affairs adopted a Resolution regarding the compliance of the initiative with the principle of subsidiarity.

The Resolution states that the proposal is in accordance with the principle of subsidiarity. Nevertheless, the proposal affects matters, which fall within the exclusive competence of the regional governments of the Member States. For this reason, it is essential to lay down clearly, that the regional governments of the Member States competent in this realm will be entitled to access the future Asylum and Migration Fund, in their relevant share.
