The government submitted EU documents 16433/12 and 16428/12 to the Chamber of Deputies on 11/21/2012.
Committee for European Affairs decided on 11/22/2012 by resolution No. 265 to discuss the document and appointed members Mrs. Soňa Marková and Mr. Viktor Paggio as rapporteurs.
Committee for European Affairs at its 39th meeting on 11/22/2012 by resolution No. 274

1. takes into account the Communication from the Commission to the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions - Gender balance in business leadership: a contribution to smart, sustainable and inclusive growth and further takes note of the framework government position on this Communication;

2. takes into account the Proposal for a Directive of the European Parliament and of the Council on improving the gender balance among non-executive directors of companies listed on stock exchanges and related measures;

3. expresses the view that any potential measures which aim to prescribe legally binding quotas represent an exceptional and last case solution that should only be adopted after undertaking a thorough deliberation in national parliaments and after all other possible measures based on the principle of voluntariness have failed;

4. therefore calls upon the Government to not consent to the proposed directive at the meeting of the EU Council;

5. in accordance with Protocol (No. 2) on the application of the principles of subsidiarity and proportionality hereby adopts a reasoned opinion in relation to the Proposal for a Directive of the European Parliament and of the Council on improving the gender balance among non-executive directors of companies listed on stock exchanges and related measures. The Committee for European Affairs expresses, in accord with the position expressed by the Government of the Czech Republic, that the proposed directive does not comply with the principle of subsidiarity, given that the adoption of affirmative measures in accordance with Article 157, paragraph 4 TFEU should be taken as closely as possible to the citizens, in this case, at the level of the Member States;

6. considers the date of publication of the proposal to be unfortunate, given that the eight-week time period during which a reasoned opinion may be adopted includes the Christmas holidays, which reduces the time that is in fact available for deliberation of the proposal in national parliaments;

7. authorizes the Committee Chairman to transmit this resolution, through the President of the of the Chamber of Deputies, to the Government, the President of the Senate, the President of the European Parliament, the President of the Council and to the President of the European Commission, in accordance with the rules of procedure of the Chamber of Deputies;

8. requests the Government to keep the Committee informed about all measures that will be taken as well as about future deliberations relating to these documents.
