At its 35th urgent meeting of 17 January 2008, the Committee on EU Affairs of the National Assembly of the Republic of Slovenia discussed the draft position of the Republic of Slovenia on the Proposal for a Directive of the European Parliament and of the Council amending Directive 2002/22/EC on universal service and users' rights relating to electronic communications networks, Directive 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector and Regulation (EC) No 2006/2004 on consumer protection cooperation.

The Committee on EU Affairs adopted the following Position of the Republic of Slovenia:

In principle, the Republic of Slovenia supports the above Proposal. The proposed amendments aim at strengthening consumer and users rights and at greater protection of privacy and personal data in electronic communications.

Slovenia supports the possibility of separating the obligation to connect to the public communications network at fixed location and the obligation to provide publicly accessible telephone services, as it could help improve competitiveness.

Slovenia supports the proposed measures intended to improve transparency and publication of information for the end-users, thus making their choice easier. It also supports the measures providing for better accessibility of modern communication means for disabled end-users. It finds it appropriate that such issue is regulated also at Community level and is not left entirely to the discretion of Member States. Slovenia welcomes the new provisions on emergency services and the single European emergency number 112, but does not wish administrative costs to increase as a result of the Member States' obligation to submit to the Commission and the European Electronic Communications Market Authority annual reports on the measures adopted to inform the citizens of the existence and use of the single European emergency number 112.

Slovenia welcomes the amendments drafted by the Commission to Directive 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector. It welcomes the introduction of the obligation to notify of any breach of security leading to loss of users' personal data. On the other hand, the provision concerning the adoption of the technical implementing measures is related to the issue concerning the status and activity of ENISA, and special attention will need to be paid thereto when discussing the Regulation establishing the European Electronic Communications Markets Authority. Slovenia also supports the request for strengthened penal provisions and believes that efficient cross-border cooperation should be established for the implementation of national legislation. The discussion should, however, shed light on what exactly is covered by the technical implementing regulations adopted by the Commission in relation to cross-border cooperation.
