Committee for European Affairs decidedon 1/24/2013 by resolution No. 281 to discuss the document and appointed the Chairman Mr. Jan Bauer as rapporteur.
Committee for European Affairs at its 41st meeting on 1/24/2013 by resolution No. 282
1. approves the framework position of the Government of the Czech Republic relating to the Proposal for a Directive of the European Parliament and of the Council on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco and related products;
2. does not consent to the extensive transfer, to the Commission, of powers to adopt non-legislative acts of general application;
3. in accordance with Protocol No. 2 on the application of the principles of subsidiarity and proportionality, hereby adopts a reasoned opinion on the breach of the principle of subsidiarity. The Committee asserts that the goals of the proposed directive may be achieved in a satisfactory manner by means of steps and activities undertaken at the level of Member States. The adoption of measures in the area of protection of public health should respect the differences among the Member States and, in accordance with Article 168 (7) TFEU, should happen as close as possible to citizens, i.e. at the level of Member States;
4. authorizes the Committee chairperson, in accordance with the rules of procedure of the Chamber of Deputies, to transmit this resolution, through the Speaker of the Chamber of Deputies of the Parliament of Czech Republic, to the Government, to the President of the Senate, to the President of the European Parliament, to the President of the Council and to the President of the European Commission;
5. requests the government to keep the Committee informed about future deliberations of this proposal in the Council,
6. refers this proposal for a directive for the deliberation in the Committee on Health Care.
